1) Both the carrier and driver are duly authorized, individually and collectively, to operate and transport the motor vehicle from the pickup location to the designated destination. While VERTEX CARSHIP Inc. will endeavor to confirm a driver for the estimated date and price, we cannot guarantee a specific pickup or delivery date due to factors such as carrier schedules, mechanical issues, adverse weather conditions, or other unforeseen circumstances. VERTEX CARSHIP Inc. shall not be held liable for any charges or liabilities arising from delays in pickup or delivery, including, but not limited to, airline tickets or rental car fees. The carrier’s schedule will be communicated to the client upon dispatch.
2) During the selected shipping option period, the client agrees not to engage the services of any other broker or carrier. Should the client be found working with another broker or carrier during this timeframe, the upfront amount charged will be non-refundable.
3) Contracted carriers provide door-to-door transport, contingent upon the truck driver’s ability to physically access the pickup and delivery addresses. If access is restricted due to factors such as narrow streets, low-hanging trees, or tight turns, the driver may request to meet at a nearby large parking area, such as a grocery store parking lot.
4) Carriers are not licensed or insured to transport personal or household goods. However, we acknowledge that you may wish to place some items in the vehicle. The carrier will not be held responsible for any damage resulting from excessive or improper loading of personal items. Such items must be placed in the trunk and are limited to a maximum weight of 100 lbs (45 kg), unless prior approval is obtained from VERTEX CARSHIP Inc. Additional fees may apply for personal items including and exceeding this weight limit. Any misrepresentation of personal belongings will result in a price adjustment and a dry run fee of $150 if the carrier attends the pickup and the shipment differs from the expected arrangement. Should a carrier be dispatched and the vehicle is not ready as indicated by the shipper, an additional rescheduling fee of $75.00 will apply. In the event that the shipper is unavailable for pickup or delivery, an alternate representative must be designated.
5) Vehicles must be in good running condition and have no more than half a tank of fuel when handed over to the carrier. The carrier is not liable for damage caused by leaking fluids, freezing, exhaust systems, or unsecured antennas. Any claims for loss or damage must be noted and signed on the condition report upon delivery.
6) Contracted carriers maintain cargo insurance ranging from $100,000 to $250,000 per load, as well as a minimum of three-quarters of a million dollars in public liability and property damage coverage. Any damage incurred during transport is the carrier’s responsibility and not that of VERTEX CARSHIP Inc. Carriers are insured to cover damage caused by the driver or theft during transport. In the event of damage, VERTEX CARSHIP Inc. will help in providing the necessary insurance packet for the carrier to file a claim. All claims must be noted, signed, and submitted in writing within 3 days of incident.
7) If a carrier is dispatched and the vehicle is not ready as indicated by the shipper, an additional rescheduling fee of $75.00 will apply. In the event the shipper is unavailable for pickup or delivery, an alternate representative must be designated. If, for any reason, the vehicle becomes unavailable during the scheduled pickup window after the order has been placed, the deposit amount will not be refunded.
8) It is imperative that the client never release or receive a vehicle from a carrier without an inspection report (Bill of Lading/BOL), irrespective of the time of day or weather conditions. Failure to obtain and document the inspection report may preclude the client from filing a damage claim. Carriers’ insurance only covers claims for damages resulting from the carrier’s negligence. Any damage must be reported to VERTEX CARSHIP Inc. within 24 hours of delivery. The damage must be clearly documented on the BOL and signed by the driver without exception. If damage occurs during transport, the client must record it on the final inspection report, settle any remaining balance as per the agreement, and then contact both the carrier’s main office and their insurance company. Failure to document any damage on the final inspection report will release the carrier from any liability and forfeit the right to file a damage claim.
9) A non-operational fee of $150.00 will be assessed for all non-running vehicles. This fee will be included in the final quote provided by VERTEX CARSHIP Inc. If the vehicle becomes non-operational during transport, this fee will be added to the original quote. The final quote will be presented to the customer at the time the carrier is dispatched for vehicle pickup.
10) While VERTEX CARSHIP Inc. strives to promptly assign a carrier for vehicle transport in accordance with your instructions, we cannot guarantee specific pickup or delivery dates. A cancellation fee of $200 will apply to orders canceled within 7 days of the requested pickup date. VERTEX CARSHIP Inc. is not responsible for rental vehicle expenses or any mechanical or operational failures of your vehicle. The shipper agrees to pay the quoted price to VERTEX CARSHIP Inc. for delivered vehicles and will not dispute the payment through credit card chargebacks. This agreement and any associated shipments are governed by the terms and conditions of the carrier’s tariff and the Uniform Straight Bill of Lading, which are available at the carrier’s office.

12) This agreement is governed by the laws of the State of Texas and shall be interpreted in accordance with them. The parties agree that any legal action arising from this agreement must be filed in a court of competent jurisdiction within Texas. VERTEX CARSHIP Inc.’s liability is limited to the broker’s fee only. The client consents to the jurisdiction of such courts and waives any right to jurisdiction in any other location.
By accepting the transport terms provided by VERTEX CARSHIP Inc., the client authorizes an upfront payment via credit or debit card, check by phone, mail, or ACH payment. The client acknowledges that the remaining balance is due upon delivery and must be paid in full by cash, cashier’s check, or money order to the authorized transporter.
